GDPR Compliance
1. Data Controller and Processor Roles
For demo requests, website interactions, and marketing communications, Outsource EQ acts as the data controller. For business customers under a signed agreement, the customer remains the data controller of all Customer Business Data. Outsource EQ acts solely as a data processor, processing Customer Business Data only to provide and support the Service, in accordance with the signed agreement, these Terms, and our Privacy Policy
2. Data Processing Agreement (DPA)For customers located in the EEA, the United Kingdom, or Switzerland, Outsource EQ  provides a Data Processing Agreement (“DPA”) that incorporates the European Commission’s Standard Contractual Clauses where applicable. A signed DPA is available upon request during the contracting process.
3. User RightsIndividuals whose data is processed by Outsource EQ under GDPR have the following rights:
- Right of access – obtain a copy of personal data.Right to rectification – request corrections.
- Right to erasure – request deletion in certain circumstances.
- Right to data portability – request transfer to another provider.
- Right to restrict processing – request limited use of data.
- Right to object – object to processing based on legitimate interests.
- Right to lodge a complaint – file a complaint with a supervisory authority..
4. Data TransfersWhere personal data is transferred outside the EEA, UK, or Switzerland, Outsource EQ ensures appropriate safeguards are in place, such as Standard Contractual Clauses and the EU–US Data Privacy Framework.
5. Breach NotificationIn the event of a personal data breach likely to result in a risk to the rights and freedoms of individuals, Outsource EQ will notify affected customers without undue delay and, where required, within 72 hours.
Governing LawThese Terms shall be governed and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions.Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
ChangesWe reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
